Located along the red banks of the Navesink River - five miles from the Atlantic Ocean and 25 miles from Manhattan - Red Bank is central to the borough of Red Bank - a town known for shopping, the Count Basie theater and some of the finest restaurants and bars in New Jersey: The Downtown, Red and the Dublin House.

Red Bank is a great place to eat, drink, be merry and shop until you drop, but sometimes citizens and visitors get a little too merry and end up standing before the man in the Municipal Court in Red Bank for traffic matters, Possession of less than 50 grams of marijuana, Possession of Drug Paraphernalia, open container, resisting arrest, DWI, reckless driving and other disorderly persons and misdemeanor violations.

Or for more serious matters, the Superior Court in Freehold.

Party Fouls: Possession of 50 Grams or Less of Marijuana

Since Red Bank is a town where people come to party, a large number of the offenses there have to do with alcohol and drugs.

Fifty grams of marijuana is the equivalent of 1.7 ounces of marijuana and in New Jersey, possession of 50 grams or less of marijuana is considered a Disorderly Persons offense. This offense is not tried in Superior Court, but it’s still a drug offense with jail and fines and a potentially permanent blot on your criminal record.

The penalty is up to six months in jail and a fine of no more than $1,000. If the possession takes place within 1000 feet of a school, add 100 hours of community service to the penalty, and an additional fine.

Although this matter is not heard before a Superior Court, it is still an offense that neither you, nor a loved one, want to have on your criminal record. For Red Bank, Tara Breslow-Testa is a criminal defense attorney who is ready to defend you if you have been charged with possession of less than 50 grams of marijuana.

Party Fouls: Open Container

New Jersey statutes 39:4-51a and N.J.S.A. 39:4-51b detail alcohol-related offenses, which include:

Driving with an open container which means the driver of the vehicle is drinking alcohol, or passengers in the car are drinking. It is illegal for any driver or passenger of a car to have unsealed alcohol, unless it is in the trunk of the car.

For the first offense the fine is $200 with court surcharges.

For the second offense, there is a fine of $250 and 10 days of community service with community surcharges.

For subsequent offenses, the fines and penalties increase.

If you are convicted of open container, that offense goes on your driving record which can have ramifications down the line with insurance and jobs.

Open container is not a charge to be brushed off. If charged with open container, the first person you should talk to is Tara Breslow-Testa, a defense attorney serving Red Bank.
