Degree of Criminal Charges in Monmouth County Superior Court

Depending on the specific offense, you may face charges for a first, second, third, or fourth degree crime. First degree crimes are considered the most egregious under New Jersey law and are punishable by a sentence to serve between 10 and 20 years in New Jersey State Prison. Second degree crimes are also very serious, resulting in prison terms ranging from 5 to 10 years. Third degree crimes are slightly different from the two mentioned previously, as they entail a presumption of non-incarceration for first time offenders. This means that if you have no prior criminal record and are charged with a third degree crime, you may be considered a good candidate for probation or a diversionary program such as Drug Court or Pre-Trial Intervention (PTI). Fourth degree crimes are the lowest-level felony offenses, and may result in a sentence to serve up to 18 months in NJ State Prison.
